Welcome to Eventist. These Terms of Service ("Terms") govern your access to and use of the website www.eventist.ca (the "Site"), mobile applications, and all related services provided by Eventist (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately.
1. Eligibility and Age Restrictions
You must be at least 16 years of age to create an account or use the Services. If you are between 16 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Services are not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected data from a child under 13, we will delete it promptly.
2. Platform Role and Relationship
Eventist is a technology platform that provides tools for event organizers ("Organizers") to create, manage, and sell tickets or registrations for events, and for attendees ("Attendees") to discover and purchase tickets or register for events.
Eventist is not the creator, organizer, or host of any event listed on the platform. Eventist acts as an intermediary and agent for Organizers in facilitating ticket sales. All transactions for event tickets are between the Organizer and the Attendee. Eventist is not responsible for the quality, safety, legality, or any other aspect of events listed on the platform.
3. Use of Our Services
You may use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Use the Services in any manner that could disable, damage, or impair the platform or interfere with any other party's use.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems or networks connected to the Services.
- Use any automated means (including bots, scrapers, crawlers, or spiders) to access, monitor, or copy any content from the Services without our prior written consent.
- Harvest or collect email addresses or other personal information of other users.
- Use the Services to transmit spam, chain letters, or unsolicited communications.
- Impersonate any person or entity or misrepresent your affiliation with a person or entity.
- Circumvent, disable, or interfere with security-related features of the Services, including features that prevent or restrict use or copying of content.
4. User Accounts and Responsibilities
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your access if we determine you have violated these Terms or misused the platform.
5. No Warranty or Guarantee of Functionality
Eventist is provided "as is" and "as available." While we work hard to keep our Services stable and reliable, we cannot guarantee the platform will be uninterrupted, secure, or error-free at all times. Website outages, bugs, data loss, or temporary unavailability may occur due to maintenance, updates, internet issues, or unforeseen technical problems. We are not responsible for any loss or damage resulting from the unavailability or malfunction of our Services. You acknowledge and agree that use of the Eventist platform is at your own risk, and we expressly disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Service-Level Agreements (SLAs)
Unless you have signed a separate written contract with us specifying performance guarantees, we do not provide any form of service-level agreement, including uptime guarantees, customer support response times, or feature commitments. All service reliability, responsiveness, and uptime guarantees apply only if you are a contracted customer with explicitly documented terms.
7. Account Configuration and Misconfigurations
You are solely responsible for the configuration of your account, events, ticket types, pricing, schedules, coupons, discounts, and any other settings within the platform. Eventist is not responsible for any loss of revenue, overselling, underselling, incorrect pricing, scheduling conflicts, or any other adverse outcomes resulting from improperly configured accounts, events, or settings. It is your obligation to review and verify all configurations before publishing or making them available to the public. Eventist provides the tools -- how you use them is entirely your responsibility.
8. Organizer Responsibilities
If you use the Services as an Organizer, you agree to the following:
- Compliance: You are solely responsible for ensuring that your events comply with all applicable local, provincial, national, and international laws, including obtaining all necessary licenses, permits, and insurance.
- Event Information: You are solely responsible for the accuracy and completeness of all event details, including descriptions, dates, times, venue information, pricing, ticket availability, and any restrictions or requirements.
- Attendee Disputes: You are responsible for resolving any disputes with Attendees, including those arising from inaccurate or misleading event information, event cancellations, or event quality.
- Data Protection: When you collect Attendee data through the platform, you act as the data controller for that data and must comply with all applicable privacy and data protection laws. You must not use Attendee data for any purpose other than managing the event and communicating relevant event-related information, unless the Attendee has given separate, explicit consent.
- Refund Policies: You are responsible for establishing and communicating your own refund and cancellation policies to Attendees. Eventist may facilitate refunds on your behalf but is not obligated to do so.
9. Coupons, Discounts, and Promotions
Unless explicitly stated otherwise in writing by Eventist, coupons and discount codes cannot be combined or stacked with other coupons, discounts, or promotions. Only one coupon or discount code may be applied per transaction. Eventist reserves the right to void, cancel, or refuse to honor any coupon or discount that is used in a manner inconsistent with its intended purpose, including unauthorized duplication, abuse, or fraud. You are solely responsible for configuring your own coupons, discounts, and promotions correctly. Eventist is not liable for any revenue loss or unintended discounts resulting from misconfigured promotional codes or settings.
10. Ticketing and Scheduling
Eventist provides ticketing and scheduling tools for Organizers and Attendees. By using these features, you acknowledge and agree:
- Ticket Cancellation and Refunds: Eventist reserves the right to cancel any ticket and issue a refund for any reason, at any time, at its sole discretion, including situations involving suspected fraud, policy violations, platform integrity concerns, or event cancellations.
- No Guarantee of Sales: Eventist does not guarantee any level of ticket sales, attendance, or revenue. We are not responsible for loss of sales, low attendance, or any financial shortfall.
- Ticket Transfers: Tickets purchased through Eventist may not be transferred to a third party unless the Organizer has explicitly enabled ticket transfers for the event. Resale of tickets is not supported on the platform. Any unauthorized transfer may result in the ticket being voided without refund.
- Scheduling Conflicts: Eventist is not responsible for double-bookings, scheduling conflicts, or overlapping events resulting from your use of the scheduling tools.
11. Payment Processing and Third-Party Services
Eventist integrates with third-party payment processors (such as Stripe and Square) to facilitate transactions. Eventist is not responsible for any errors, delays, or failures in payment processing caused by these third-party services. You agree to comply with the terms and conditions of any third-party payment processor used in connection with the Services. Eventist is not liable for any chargebacks, disputes, or payment reversals initiated by payment processors or financial institutions.
12. Fees
Eventist may charge fees for use of certain features of the Services. Fee schedules are published on the Site and may be updated from time to time. Organizers are responsible for understanding the fee structure that applies to their use of the Services. All fees are exclusive of applicable taxes unless stated otherwise.
13. Eventist Elite
Eventist Elite is offered on a monthly subscription basis. By subscribing, you agree to be billed automatically each month unless you cancel your subscription prior to the next billing cycle.
All payments are final and non-refundable. This includes partial months of service, accidental purchases, or unused time.
Some features may incur additional charges, such as usage-based fees for SMS, email, call minutes, or other services. These add-ons are billed separately and must be paid in full to avoid interruption of service. By maintaining an active subscription, you agree to keep a valid payment method on file for both the base subscription and any add-on charges.
Eventist is not responsible for any additional charges incurred from paid add-ons or third-party service usage. It is solely the subscriber's responsibility to review, understand, and manage these optional charges. By using the platform, you agree not to dispute or deny awareness of these charges after they are incurred.
14. Refund and Cancellation Policy
Eventist reserves the right to cancel any order, ticket, or registration and issue a full or partial refund at any time, for any reason, at its sole discretion. This includes cancellations due to suspected fraud, duplicate orders, policy violations, event cancellations, or platform integrity concerns. Eventist is not responsible for any costs, losses, or damages incurred by you or any third party as a result of such cancellations or refunds, including travel expenses, accommodation costs, or lost business opportunities.
15. User Content
"User Content" means any text, images, videos, audio, reviews, comments, event descriptions, logos, or other materials that you upload, post, or transmit through the Services.
- Ownership: You retain ownership of your User Content.
- License Grant: By submitting User Content, you grant Eventist a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating, promoting, and improving the Services. This license continues even if you stop using the Services, but only with respect to User Content that was shared or made public prior to termination.
- Responsibility: You are solely responsible for your User Content and represent that you have all necessary rights to grant the above license. You must not submit content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable.
- Moderation: Eventist may, but is not obligated to, review, monitor, or remove User Content at any time, for any reason, without notice.
16. Intellectual Property
All content, features, and functionality on the Site (including text, graphics, logos, software, and the Eventist brand) are the exclusive property of Eventist or its licensors. You may not reproduce, distribute, modify, or publicly display any part of our Services without our prior written permission.
17. Copyright Infringement (DMCA)
Eventist respects the intellectual property rights of others. If you believe that content on the Services infringes your copyright, you may submit a takedown notice to our designated agent with the following information:
1. A description of the copyrighted work you claim has been infringed.
2. A description of the material you claim is infringing and its location on the Services.
3. Your contact information (name, address, telephone number, and email address).
4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
6. Your physical or electronic signature.

We may remove or disable access to allegedly infringing material and may terminate the accounts of repeat infringers.
18. Electronic Communications Consent
By creating an account or purchasing a ticket through the Services, you consent to receive electronic communications from Eventist, including:
- Transactional emails (order confirmations, receipts, event updates).
- Service-related announcements (maintenance notices, security alerts, policy changes).
- Marketing communications (promotional offers, newsletters, event recommendations).
You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any marketing email or by adjusting your account notification settings. You may not opt out of transactional or service-related communications while you maintain an active account.
SMS/Text Messages: If you opt in to receiving SMS notifications, you consent to receive automated text messages from Eventist. Message and data rates may apply. Reply STOP to opt out at any time. Eventist will not share your SMS opt-in data with third parties for marketing purposes.
19. Privacy and Data Protection
Your privacy is important to us. For details on how we collect, use, and protect your information, please refer to our Privacy Policy. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
20. Assumption of Risk for Events
By attending any event discovered or booked through Eventist, you voluntarily assume all risks associated with attending the event, including but not limited to risks of personal injury, illness (including exposure to communicable diseases), property damage, or death. Eventist is not the host or organizer of events and has no control over the conditions, safety measures, or conduct at any event. You release Eventist from any and all claims arising from your attendance at any event.
21. Limitation of Liability
To the maximum extent permitted by law, Eventist and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of (or inability to access or use) the Services. This includes, without limitation, damages for lost profits, lost data, loss of goodwill, service interruptions, or other intangible losses -- even if we have been advised of the possibility of such damages.
Without limiting the foregoing, Eventist shall not be liable for any loss of revenue, ticket sales, or business opportunities arising from account misconfigurations, improperly set pricing, coupon errors, scheduling mistakes, or any other user-controlled settings.
In no event shall Eventist's total aggregate liability exceed the greater of (a) the amounts paid by you to Eventist in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).
In jurisdictions where limitations of liability are not fully permitted, our liability is limited to the fullest extent permitted by law.
22. Indemnification
You agree to indemnify, defend, and hold harmless Eventist, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses -- including legal fees -- arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, your User Content, or any misconfiguration of your account or event settings that results in disputes, financial losses, or third-party claims.
23. Dispute Resolution
Please read this section carefully. It affects your legal rights.
- Informal Resolution First: Before initiating any formal dispute resolution process, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.
- Governing Law: These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
- Jurisdiction: If informal resolution is unsuccessful, any legal action or proceeding relating to these Terms or the Services shall be brought exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction of such courts.
- Class Action Waiver: To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found to be unenforceable in your jurisdiction, then this entire dispute resolution section shall be void solely with respect to you.
24. Account Termination
We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, with or without cause, and with or without notice, at any time. Reasons for termination may include violation of these Terms, suspected fraud or abuse, inactivity, or any conduct that we determine to be harmful to Eventist, its users, or third parties. Upon termination, your right to use the Services will immediately cease. Eventist shall not be liable to you or any third party for any termination of your access to the Services. Sections that by their nature should survive termination (including indemnification, limitation of liability, intellectual property, and dispute resolution) will survive.
25. Force Majeure
Eventist shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, epidemics, war, terrorism, civil unrest, power outages, internet or telecommunications failures, or cyberattacks.
26. Accessibility

27. Changes to the Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of the page and may notify you by email or through the Services. We encourage you to review the Terms periodically. Your continued use of the Services after changes have been posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.
28. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be enforced to the maximum extent permissible and the other provisions will remain in full force and effect.
29. Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Eventist regarding the Services and supersede all prior agreements and understandings.
